1st July 2010

ASK THE EXPERT – The Art of Lying Q. Estate Agents have a reputation for lying, falsifying or using information in a manner that deceives the general public, can you give me examples of this sort of practice and how best to spot the rogue agent. A. Unfortunately some Estate Agents will do anything to get an instruction. In March 2006 the BBC’s Whistleblower programme did an undercover documentary that found Agents lying to customers, faked signatures, false passports and dodgy deals with developers. The undercover investigation revealed the secret world of estate agents' dirty tricks

24th June 2010

ASK THE EXPERT Q. What effect if any will the Chancellor’s “Emergency Budget” have on the housing market? A. Happily, very little – as far as one can tell. Of course, this wasn’t a normal budget in any sense of the word. However, as with any budget – emergency or not - no news is almost invariably good news!

main image spacer Ask The Expert 13 - My tenant wants to buy?

29th April 2010

Q. I own a property that has been managed through an estate agent for several years. The current tenants now want to buy it, and the agent claims I am contractually obliged to pay them commission on the sale. Is this right? A. Probably not. Yes, your management contract may well include a clause to that effect, but judging by the tone of your question – which suggests that this has come as a complete surprise to you – that clause is almost certainly unenforceable.

main image spacer Ask The Expert 12 - New £250,000 Stamp Duty Threshold

26th March 2010

Q. I’m confused. Is the new £250,000 Stamp Duty threshold good news? A. That rather depends. Unlike the previous Stamp Duty holiday, for example, which came to an end last December and which temporarily applied to all purchases up to £175,000, this one is specifically designed to benefit first time buyers only.

main image spacer Ask the Expert 11 - General advice on buying a property

18th February 2010

Q. This may sound stupid, but I’m looking to buy a new property, and I wondered if you could give me any general advice on how to proceed. A. On average, people only move home every 6 or 7 years, so this isn’t a stupid question at all.

main image spacer Ask The Expert 10 - Market Value & Insured Value ?

8th February 2010

Q. I was surprised to learn that there still seems to be quite a discrepancy between the market value of my home and its insured value. Why is this – and how do I know if I have adequate cover? A. The market value of a property, and the value that is put on it for insurance purposes, are two very different things. Market value obviously reflects the price someone is prepared to pay for your home, while insured value is based on a calculation of what it would actually cost to rebuild it to the same specification in the event of something like a major fire. Even in the current market, the former is almost always higher – primarily because the insured value doesn’t take into account the value of the land on which a property sits. Consequently, this discrepancy shouldn’t really be a concern.

main image spacer Ask The Expert 9 - What are Chancel Repairs?

24th January 2010

Q. I live near my local church. Does that mean I’m liable for chancel repairs? A. If you had asked me this question a few years ago, I would probably have told you not to worry. Recently, however, a widely-publicised test case has seen a Warwickshire couple forced to auction their home to meet a chancel repair bill of almost £190,000.

main image spacer Ask The Expert 8 - Unregistered Title?

21st January 2010

Q. If you own a property that is currently unregistered, is there any value in voluntarily registering it? A. Although a central register of the ownership of all property has been in preparation for well over a century, it was left up to individual counties and other responsible local authorities to decide when they joined the scheme. So, it was only in 1990 that registration finally became compulsory in all parts of England and Wales –

main image spacer Ask The Expert 7 - What is the shelf life of a HIP?

19th January 2010

Q. How long is my Home Information Pack valid for – and does it make a difference if I have to take my home off the market temporarily? A. This is one of those HIP-related issues which, thanks to the rather ambiguous wording of the regulations, continue to cause a certain amount of confusion – and not just amongst the general public, either.
