main image spacer Ask the Expert 11 - General advice on buying a property

18th February 2010

Q. This may sound stupid, but I’m looking to buy a new property, and I wondered if you could give me any general advice on how to proceed. A. On average, people only move home every 6 or 7 years, so this isn’t a stupid question at all.

main image spacer Ask The Expert 10 - Market Value & Insured Value ?

8th February 2010

Q. I was surprised to learn that there still seems to be quite a discrepancy between the market value of my home and its insured value. Why is this – and how do I know if I have adequate cover? A. The market value of a property, and the value that is put on it for insurance purposes, are two very different things. Market value obviously reflects the price someone is prepared to pay for your home, while insured value is based on a calculation of what it would actually cost to rebuild it to the same specification in the event of something like a major fire. Even in the current market, the former is almost always higher – primarily because the insured value doesn’t take into account the value of the land on which a property sits. Consequently, this discrepancy shouldn’t really be a concern.

main image spacer Ask The Expert 9 - What are Chancel Repairs?

24th January 2010

Q. I live near my local church. Does that mean I’m liable for chancel repairs? A. If you had asked me this question a few years ago, I would probably have told you not to worry. Recently, however, a widely-publicised test case has seen a Warwickshire couple forced to auction their home to meet a chancel repair bill of almost £190,000.

main image spacer Ask The Expert 8 - Unregistered Title?

21st January 2010

Q. If you own a property that is currently unregistered, is there any value in voluntarily registering it? A. Although a central register of the ownership of all property has been in preparation for well over a century, it was left up to individual counties and other responsible local authorities to decide when they joined the scheme. So, it was only in 1990 that registration finally became compulsory in all parts of England and Wales –

main image spacer Ask The Expert 7 - What is the shelf life of a HIP?

19th January 2010

Q. How long is my Home Information Pack valid for – and does it make a difference if I have to take my home off the market temporarily? A. This is one of those HIP-related issues which, thanks to the rather ambiguous wording of the regulations, continue to cause a certain amount of confusion – and not just amongst the general public, either.

main image spacer Ask The Expert 6 - Property Information Questionnaire?

16th January 2010

Q. Can you tell me a bit more about this new Property Information Questionnaire? A. From 6th April, all Home Information Packs must contain a Property Information Questionnaire, or PIQ, completed by the seller, and covering a whole range of issues which the Government believes buyers are interested in, or should be concerned about.

main image spacer Ask The Expert 5 - Extend my Lease?

14th January 2010

Q. Am I legally entitled to extend the lease of my flat – and if so, at what point would it be most beneficial to do so? A. Under the Leasehold Reform, Housing and Urban Development Act 1993 (as subsequently amended), you are entitled to a 90-year extension on your lease – as long as you have already held it for more than 2 years. However -

main image spacer Ask The Expert 4 - Buy the Freehold ?

12th January 2010

Q. I own a leasehold flat and I have heard that I can, with my neighbours, purchase the freehold. Is this true, and how do we go about it? A. Yes, it is true. Indeed, under the Leasehold Reform, Housing and Urban Development Act 1993 (subsequently amended by the Commonhold and Leasehold Reform Act 2002), most lessees actually have a legal right to buy the freehold.

main image spacer Ask The Expert 3 - Fences

10th January 2010

. I have recently moved, and I’m not certain which fence is mine. According my immediate neighbours, I’m responsible for both sides, but that can’t be right, can it? A. Obviously, the last thing you want to do is fall out with your new neighbours, not least because disagreements over boundaries can sometimes escalate into quite unpleasant and long-running disputes. Nevertheless, by the sound of it, one or other of them is wrong.

main image spacer Ask The Expert 2 - legal indemnity insurance?

6th January 2010

Q. I am currently looking to sell my home, and have been advised that I should think about taking out something called legal indemnity insurance. What exactly is this? A. Legal Indemnity Insurance is not something that many people will have come across. Unless, that is, they have been involved in a previous property transaction which has been delayed or even prevented from going through altogether, due to some legal complication

main image spacer Ask The Expert 1 - Redress

4th January 2010

Q. Who can I turn to if I have a complaint against an estate agent? A. Under the Consumer Estate Agents and Redress Act (2007), which came into force in October 2008, all practising estate agents are obliged to belong to a redress scheme approved by the Office of Fair Trading.

main image spacer UNDERVALUED ?

1st January 2010

Q. I have only been on the market a couple of days, I’ve had one viewing and they have made an offer. Does this mean my property was undervalued? A. I can understand why you might think so. In fact, you probably won’t be surprised to learn that this is one of the commonest issues that people raise.
